These Terms of Service ("Terms") govern your access to and use of the MSSHINE platform, websites and related services (collectively, the "Service") provided by MSSHINE PRIVATE LIMITED ("MSSHINE", "we", "us"). Please read them carefully.
By creating an account, starting a trial, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.
MSSHINE is an AI-powered restaurant management platform offering modules for orders and point-of-sale, inventory, staff scheduling, demand forecasting, customer relationship management, finance and analytics. Features available to you depend on your subscription plan.
Paid plans are billed on a monthly or annual basis per outlet, as selected at checkout. Fees are charged in advance and are non-refundable except where required by law. You may upgrade, downgrade or cancel at any time from your dashboard; changes take effect at the end of the current billing cycle. Free trials convert to a paid plan only if you choose to subscribe.
You agree not to misuse the Service. In particular, you will not:
You retain all rights to the data you and your customers submit to the Service ("Customer Content"). You grant MSSHINE a limited license to process Customer Content solely to provide, maintain and improve the Service, as described in our Privacy Policy. You are responsible for the lawfulness of the Customer Content you provide.
The Service, including its software, design, models and trademarks, is owned by MSSHINE and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service, and no other rights are granted by implication.
The Service includes AI-driven predictions, forecasts, recommendations and summaries. These outputs are advisory only and are provided on a best-effort basis. They may be inaccurate or incomplete and should not be relied upon as the sole basis for business, financial, staffing or compliance decisions. You remain responsible for verifying outputs and for decisions made using them.
We aim to keep the Service available and reliable, targeting high uptime with monitored, redundant infrastructure. Occasional maintenance or factors beyond our reasonable control may cause interruptions. Support levels vary by plan, with priority and dedicated support available on higher tiers. Specific service-level commitments, where offered, are set out in your subscription agreement.
To the maximum extent permitted by law, MSSHINE shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
You may terminate your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, or use the Service in a manner that risks harm to others or to the Service. On termination, your right to use the Service ceases; you may export your data within a reasonable period before deletion in line with our retention practices.
These Terms are governed by the laws of India. The courts of Ahmedabad, Gujarat shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to applicable law.
